1) Definitions
- “AURA Neural”, “we”, “us”, “our” means AssistControl S.R.L., Str. Frasinului 11, Corbeanca, Ilfov, Romania.
- “You” / “User” means any person accessing or using the Service.
- “Content” includes text, audio, prompts, session outputs, recommendations, and other materials provided through the Service.
- “User Content” means information you submit (e.g., notes, messages, journal entries including dream notes, goals, preferences).
2) The Service (Wellness, not medical)
AURA Neural provides guided resonance-based audio sessions and guidance features intended to support general wellness goals (e.g., calm, focus, sleep). The Service is not a medical device and does not provide diagnosis, treatment, cure, or prevention of any disease. See the Disclaimer.
3) Eligibility
You must be at least 16 years old (or the age of digital consent in your country, if higher) to use the Service. By using the Service, you represent that you meet this requirement.
4) Account registration and security
Some features require an account. You agree to provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
5) Safety requirements
You agree to use the Service safely:
- Use headphones where recommended and keep volume at a safe level.
- Do not use the Service while driving, cycling, or operating machinery.
- If you have epilepsy, a history of seizures, or sensitivity to rhythmic stimuli, consult a qualified professional before use.
- Stop using the Service if you feel discomfort, dizziness, nausea, anxiety, or other adverse symptoms.
6) Subscriptions, fees, and payment
AURA Neural may offer free and paid tiers and recurring subscriptions. Prices, billing periods, and included features are shown at purchase. Taxes may apply depending on your location. Payments are processed by third-party payment processors; we generally do not store full payment card details (except as permitted via processor tokenization).
7) Renewal and cancellation
If you purchase a subscription, it may renew automatically unless you cancel before the renewal date. You can cancel through your account settings or the platform through which you subscribed. Access typically continues until the end of the current billing period.
8) Trials and promotions
Trial and promotion terms will be disclosed at the time of the offer. We may modify or end trials/promotions to the extent permitted by law.
9) Refund policy
Unless required by law, fees are non-refundable. If you experience a verifiable technical issue, contact support with details. We may review and offer a refund or credit at our discretion, where appropriate and permitted by law.
10) Acceptable use
You agree not to:
- Use the Service for unlawful purposes or in violation of applicable laws.
- Interfere with or disrupt the Service, security, or servers.
- Attempt to access other users’ accounts or data.
- Reverse engineer, scrape, or extract data from the Service except as permitted by law.
- Use the Service to generate or disseminate harmful, abusive, or illegal content.
11) Guidance features (e.g., “Aura Bridge”)
The Service may provide guidance prompts, recommendations, and reflective content based on your inputs. Outputs are informational and wellness-oriented and may be inaccurate or incomplete. You are responsible for how you interpret and use outputs. Do not rely on outputs as medical, psychological, legal, or financial advice.
12) Intellectual property
The Service and its Content (excluding User Content) are owned by AURA Neural and/or its licensors and are protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.
13) User Content license
You retain ownership of your User Content. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and display your User Content solely to operate, maintain, and improve the Service (including generating your sessions and recommendations). This license ends when your User Content is deleted from our systems, subject to backups and legal obligations.
14) Feedback
If you submit feedback or suggestions, you grant us the right to use them without restriction or compensation.
15) Third-party services and links
The Service may integrate with third-party services (e.g., payment processors, authentication, analytics, hosting). Your use of third-party services is subject to their terms and policies. We are not responsible for third-party services.
16) Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that results will be achieved.
17) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AURA Neural will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the Service.
To the extent permitted by law, our total liability will not exceed the amount you paid us for the Service in the 12 months before the event giving rise to the claim (or EUR 50 if you paid nothing). Some jurisdictions do not allow certain limitations; in that case, limitations apply to the maximum extent permitted.
18) Indemnification
You agree to indemnify and hold harmless AURA Neural from claims, damages, liabilities, and expenses (including attorneys’ fees) arising from your use of the Service, your User Content, or your violation of these Terms or laws.
19) Termination
We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users. You may stop using the Service at any time. Upon termination, your right to use the Service ends.
20) Changes to the Service and Terms
We may modify the Service and these Terms from time to time. If changes are material, we will provide notice as required by law. Continued use after changes take effect means you accept the updated Terms.
21) Governing law and disputes
These Terms are governed by the laws of Romania, without regard to conflict of laws rules. Courts located in Ilfov, Romania will have jurisdiction, unless mandatory consumer laws provide otherwise.
